UPERC Rejects Avaada Indsolar's Plea for Full Energy Banking
Mar 26, 2025
The Uttar Pradesh Electricity Regulatory Commission (UPERC) has rejected a petition filed by Avaada Indsolar Private Limited seeking directions to allow 100?nking of energy generated by its solar power plant.
Petition Details
The petition requested the Uttar Pradesh Power Corporation Limited (UPPCL) to enter into an agreement for full energy banking. However, the commission cited a prior ruling by the Appellate Tribunal for Electricity (APTEL) in the case of M/s Inox (Appeal No. 308 of 2024 in Petition No. 1994 of 2023), which established that such relief could not be granted.
Commission’s Observations
UPERC further noted that Avaada Indsolar had not provided evidence of UPPCL’s refusal to sign a banking agreement for 25% of the energy generated, which is already permitted under the existing regulations.
Conclusion
Since the petition lacked justification for the requested relief and referenced a precedent dismissing a similar claim, the commission decided to reject Avaada Indsolar’s plea. The decision reaffirms the regulatory stance on energy banking in Uttar Pradesh, maintaining the 25% energy banking limit. Industry stakeholders are now expected to align their agreements with the existing framework.
