Greenyana Solar’s Appeal on Tariff Determination Heard by APTEL

The Appellate Tribunal for Electricity (APTEL) is hearing an appeal filed by Greenyana Solar Private Ltd (GSPL) against an order from the Haryana Electricity Regulatory Commission (HERC) regarding the tariff determination for power supply under a Power Purchase Agreement (PPA). The main issue in dispute is whether the HERC correctly determined the capital cost using an AC:DC ratio of 1:1 for the project's capacity calculation or if a different ratio should have been used. GSPL contends that this ratio led to an undervaluation of the project’s capacity, which resulted in a reduced tariff.

The Tribunal determined that the HERC regulations do not specify a mandatory AC:DC ratio for determining the Capacity Utilization Factor (CUF). It directed the State Commission to conduct a prudence check to evaluate the appropriate ratio and related costs.

In the interim, the Tribunal set an interim tariff of Rs2.50/kWh, as per the agreed PPA, until the State Commission arrives at a final decision. The case has been remanded to the Commission for reconsideration of the AC:DC ratio, capital costs, and other tariff-related computation issues. This process is in line with Section 62 of the Electricity Act, which aims to balance economic feasibility with consumer protection and market efficiency.
